VIDEO | Toti case, the lawyer: “We will appeal for review, the rejection is not surprising”

The defender of the Ligurian governor comments on the rejection of the request for revocation of house arrest, filed today by investigating judge Paola Faggioni

GENOA – “It’s a rejection that didn’t surprise me. I expected it, also given the previews in the press in recent days. I read it: in my opinion the content gives us space to an appeal to the Court of Review which we will make next week”. Thus the lawyer Stefano Savi, legal defender of the Ligurian governor Giovanni Toti, commenting the rejection of the request to revoke house arrest, filed today by investigating judge Paola Faggioni. With Toti, adds Savi, “we made a series of observations and found ourselves in agreement: the desire to go to the Review and challenge this provision”. As regards the timing of the Review, Savi invites us to “refer to the setting of the date of the Review for Paolo Emilio Signorini which is June 28th. So, more or less it will take a month, a month and a half”.

“From the point of view of dangerousness there is the idea that those who are under investigation and not convicted are almost infinitely dangerous. I want to understand how long dangerousness lasts, taking into account that in the decision there is even reference to possible elections in 2025,” Savi said. The lawyer specifies that the investigating judge noted that both the precautionary needs connected to the danger of evidence pollution and those to the repetition of the crime remain: “If there had only been the danger of evidence pollution, a deadline would also have been indicated – he underlines- in addition to the fact that it seems a bit childish to me to think that, given everything that has been said and written, one would repeat certain behaviors. We would be crazy. We waited to ask for the revocation until the moment that seemed most appropriate (i.e. after the European elections, ed.) and if a deadline had been given to us, we would have waited for it”.

There is some contradiction regarding the lack of solid reasons evoked by the investigating judge in the reasons for the rejection, says Savi. In particular, according to the lawyer, the investigating judge “did not take into account what we said in the interrogation and in the request: when certain actions were carried out, it was done with the subjective belief of not commit crimes. We also said that, following the criminal proceedings, there would still have been an acknowledgment and awareness that, at least if one wanted to avoid being investigated again, things would have to be done in the future. do with different criteria, without prejudice to the essence of wanting to encourage any productive establishment and bring an advantage to the region”.

Savi adds that “there was no need for the investigating judge to bother the Spinellis”, cited in the rejection, “it was enough to read the statements that Toti made during the interrogation”. As for the references to elusive behavior implemented by the governor during the investigation period, the lawyer remarked that “the only one who brought the phone on Spinelli’s yacht was him because he was also intercepted. Then, reference is made to a place where Toti usually had lunch: if seeking a bit of privacy is an elusive behaviour, then everyone must be careful”. Savi adds, finally, that in the request “I have absolutely not addressed the merits of these things, but only the precautionary needs that must take into account a balance of interests”.

“Giovanni Toti’s resignation” as governor of Liguria “we find it evoked in the rejection provision: if it is said that as long as Toti is involved in politics he is dangerous, that is the reading. “We will ask to be able to meet those subjects with whom we can discuss the political future, also given that the decisions that Toti will have to make will not you can take them yourself”, continues the lawyer. A request, the latter, which could arrive even before the outcome of the appeal to the Review. Toti, concludes Savi, “is an Italian citizen who defends himself against an accusation that we believe is unjust and is using, even if some people don’t like it, everything that the law makes available to him to be able to contest this measure.” Savi tends to exclude Toti from asking to speak with the Prime Minister, Giorgia Meloni, to evaluate possible resignations, “but rather with representatives of other forces of the Ligurian majority, perhaps even remotely”.

The lawyer also explains that, as already happened with the interview permitted with the regional councilor Giacomo Giampedrone, “people who are not affected by the investigation will be chosen. Giampedrone had been shared with the investigating judge and with the Prosecutor’s Office because he had no possibility of being called as a witness and did not emerge anywhere: the logic of the measure is to ensure that no pressure can be put on possible witnesses or people who can report and Giampedrone has nothing to do with it “.
